PREFACE
Only residents of Fayette County are to be cited -- all non-residents are required by the court to post bond or to waive their appearance in
court, if eligible.
Bonds are for the purpose of assuring a person's appearance in court
at a designated time. Persons posting bond should never be advised to forfeit. The person must either appear in court at the designated time, if bond is posted; or the person must waive his or her appearance if they are eligible to waive. In all minor misdemeanor cases, the arresting officer or his superior shall make an initial determination as to whether or not a bond is necessary to insure the accused's presence in court. Consideration shall be given to the type of offense alleged committed, and the residence, employment status past history, and demeanor of the accused, in determining whether a summons shall be issued or a bond required. If there is no apparent reason after consideration of the above factors to believe the defendant will not appear in court, a summons shall be issued in lieu of bond. Normally, out of county residents shall be required to post the
appropriate bond.
In all cases in which the offense alleged is a minor misdemeanor under
state law, the accused will be issued a citation informing him that he may appear within seven (7) days at the office of the Clerk, waive trial, plead guilty, and pay a stated fine in lieu of court appearance.

ACCEPTANCE OF VALID DRIVER'S LICENSE AS BOND
Section
2937.221 of the Ohio Revised Code does not permit acceptance of driver's
license in lieu of bond for the following violations:
(1) Failure to comply with a lawful order;
(2) Vehicular homicide;
(3) Driving while under the influence of alcohol or any drug of abuse;
(4) Reckless operation;
(5) Drag racing;
(6) Resisting arrest;
(7) Leaving the scene.
Driver's license shall be held in lieu of bond on minor misdemeanor
traffic citations only, when the bond does not exceed $100.00.

* Any person released on bond for a domestic violence charge or a menacing by stalking charge shall stay completely away from the complainant and/or alleged victim until further order of the court. Notation of this added condition of release must be affixed to any document given to defendant scheduling his/her next court appearance. No exceptions to this period of isolation from the complainant and/or victim will be allowed without written order of the court. When a person is charged with violation of a CPO, SPO, or a TPO, the defendant must post a $3,000.00 cash or surety bond if the violation was not personally observed by the officer. If an officer personally observes the violation of a CPO, TPO, or SPO, or the defendant admits to the violation or if the officer makes a personal request to the Judge, the defendant shall be held without bond until the next session of
Court.
If a defendant is charged with a criminal act resulting in damage to any City or County Property while incarcerated in either the City or county Jail Facility, he or she wil be held in lieu of $3,000.00 cash or surety bond until further order of the Court.
Notes to Bond Schedule
- If the bond in misdemeanor offenses has not been previously listed in the bond schedule, then the bond for that particular section or code shall be set at the maximum amount of fine for that section or code. Law enforcement officers may request the court to raise or lower bonds upon personally contacting the court.
- If a defendant, who is charged with driving under suspension or a first degree no operator's license, has within 5 years previously been convicted for driving under suspension or no operator's license, $1,000.00 shall be added to the base bond for each conviction within 5 years. Please note, multiple no operator's license and driving under suspension convictions that are based upon and arise out of the same fact situation shall be considered as one prior conviction for the purpose of setting bond.
- If a victim in an assault case is handicapped, a minor, mentally retarded, age 65 or older, a family member, or seriously injured as a result of the assault, bond shall be $3,000.00 for a resident of the State of Ohio or $6,000.00 for a non resident of the State of Ohio.
- If a person is charged with a traffic offense, other than a minor misdemeanor, and any other person was seriously injured as a result of the offense, then the bond shall be the triplicate of the above-listed amount.
- In felony cases, except murder and manslaughter, when mandatory prison terms are applicable, bond shall be double the above-listed amount.
- Those charged with involuntary manslaughter, voluntary manslaughter, murder, or aggravated murder shall be held without bond until further order of the court.
- Except for minor misdemeanors, bond shall be double the above-listed amount for all drug offenses.
- Pursuant to Ohio Revised Code 2935.06, citations shall be issued for minor misdemeanors unless one of the exceptions is applicable.
- If any person is arrested for any offense, with the exception of a minor misdemeanor traffic offense, and is on probation with this count, the officer is ordered to hold the defendant without bond and to contact the probation officer or the court as soon as possible.
- If a person has been convicted of a theft offense within the last five years, the bond shall be double the above-listed amount.
Addendum: Person posting a bond may post a cash bond or surety bond. The Court will not accept 10 bonds unless ordered by the Court.
If a defendant is charged with a criminal act resulting in damage to any City or County Property while incarcerated in either the City or County Jail Facility, he or she will be held in lieu of $3,000.00 cash or surety bond until further order of the Court.
